Artist Submission Agreement

This Agreement (“Agreement”) is entered into on [Date] by and between [Artist’s Full Name] (“Artist”) and [Organization/Exhibition Name] (“Organizer”).

1. Submission of Artwork

The Artist agrees to submit the artwork titled “[Title of Artwork]” (the “Work”) to the [Exhibition/Competition Name] to be held on [Dates] at [Venue], subject to the terms and conditions outlined below.

2. Copyright

        •       The Artist retains full copyright of the Work. By submitting, the Artist grants the Organizer a limited, non-exclusive, royalty-free license to use, reproduce, and display images of the Work for promotional purposes related to the exhibition or competition, including but not limited to marketing, social media, and website features.
        •       The Organizer may not sell or sublicense images of the Work without the Artist’s express written permission.

3. Originality of Work

        •       The Artist warrants that the Work is an original creation and does not infringe upon any third party’s copyright, trademark, or other intellectual property rights.
        •       The Artist agrees that no unauthorized reproductions of the Work have been made or distributed.

4. Liability

        •       The Organizer will take reasonable care in handling and displaying the Work; however, the Organizer is not liable for any loss, theft, or damage to the Work while in transit, during the exhibition, or in storage, unless explicitly stated otherwise.
        •       The Artist is responsible for obtaining insurance for the Work if desired.

5. Indemnity

The Artist agrees to indemnify and hold harmless the Organizer, its employees, agents, and representatives, from and against any claims, liabilities, damages, losses, and expenses (including attorney’s fees) arising out of or in connection with:

        •       The Artist’s breach of any representation or warranty made under this Agreement.
        •       Any claim that the Work infringes on third-party rights.
        •       Any damage to property or personal injury caused by the Artist’s actions or the submission of the Work.

6. Display and Return of Work

        •       The Organizer will display the Work at the venue during the exhibition dates.
        •       The Artist will deliver the Work to the venue by [Delivery Date] and pick up the Work by [Pickup Date], or make arrangements for return shipping. The Organizer is not responsible for Work left beyond this pickup deadline unless prior arrangements have been made.

7. Sales and Commission (if applicable)

        •       If the Work is available for sale, the Artist authorizes the Organizer to sell the Work for the price of [Price].
        •       The Organizer is entitled to a commission of [Commission Percentage]% from the sale, with the remaining [Percentage]% payable to the Artist within [Number of Days] days of the sale.

8. Dispute Resolution

Any disputes arising under this Agreement shall be resolved through [Mediation/Arbitration] in accordance with the laws of [State/Country].

9. Termination

The Organizer reserves the right to terminate this Agreement if the Artist fails to comply with the terms or if the Work is deemed inappropriate or in violation of applicable laws.

10. Miscellaneous

        •       This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, agreements, or understandings.
        •       Any modifications to this Agreement must be made in writing and signed by both parties.
